On 6 and 7 November 2019 the
Supreme Court heard Morrisons’ appeal in Various Claimants v Wm Morrison
Supermarkets Ltd. The appeal raises novel and important issues concerning
employers’ liability for data breaches as a result of the actions of their
employees, and the interrelationship of the statutory data protection regime
with the common law. The Supreme Court’s decision is likely to be a landmark in
the law of both employer’s vicarious liability and data protection.
Anya Proops KC and Rupert
Paines have acted for Morrisons throughout the proceedings, led in the Supreme
Court by Lord Pannick KC.
