Morrisons and Barclays Bank: Employers, vicarious liability, and data breaches

The Supreme Court’s recent decision in Wm Morrison Supermarkets Ltd v Various Claimants has authoritatively set out the principles that apply where an employer is said to be vicariously liable for unlawful data processing by an employee. Overturning the decisions of the courts below, the Supreme Court found that Morrisons was not liable for the intentional publication of personal data by a rogue employee, who was intent on damaging his employer.

Anya Proops KC and Rupert Paines, who acted for Morrisons throughout the litigation, will give a webinar on 23 April 2020. They will discuss the implications of the Morrisons judgment for employers/data controllers, and also the Supreme Court’s companion decision in Barclays Bank plc v Various Claimants on vicarious liability for independent contractors.
