The Court of Appeal has delivered a landmark decision in Higgs v Farmor’s School, interpreting the direct discrimination provisions of the Equality Act 2010 so as to create liability where an employee is less favourably treated for manifesting a belief and to provide a defence of objective justification to an employer in appropriate circumstances.

Sean Jones KC appeared for the school, leading Chris Milson of Cloisters Chambers.

Joanne Clement KC and Tom Cross represented the Equality and Human Rights Commission at different stages in the proceedings.
