Tom Cross successful in important consultation judicial review

Tom Cross has successfully acted for the defendant in R (CU) v Secretary of State for Education [2024] EWHC 638 (Admin).

The main significance of the judgment is its detailed consideration of the question of when time starts to run in a judicial review challenge to a consultation (whether brought under the Gunning principles or otherwise). 

In paragraphs 64-86 of the Judgment, His Honour Judge Stephen Davies, sitting as a Judge of the High Court, analyses the case law and discusses in depth the options and risks for claimants.
