High Court has today handed down judgment in R (Miller) and others v Secretary of State for Leaving the European Union

Cases

“The High Court has today handed down judgment in R (Miller) and others v Secretary of State for Leaving the European Union. It decided that the Crown prerogative did not provide a power for the Government to give notification to the European Council under Article 50 of the Treaty on European Union. The Divisional Court granted a leapfrog certificate, enabling the Government to apply to appeal their order directly to the Supreme Court. The Supreme Court has set aside 5-8 December 2016 for the hearing of an appeal.

Jason Coppel KC, Tom Cross, and Christopher Knight are instructed by Her Majesty’s Government.

The judgment is available here.
