Daniel Stilitz KC and Joseph Barrett acted successfully for the Secretary of State, defending the scheme of the trade union recognition legislation against a challenge by the IWGB.  The union had argued that the legislation was incompatible with Article 11 of the Convention because it precluded an application for recognition for collective bargaining purposes when there was already a voluntary agreement in place with another, independent trade union.
