This week (12-13 December 2023) the Supreme Court will hear the appeal in Mercer v Alternative Futures Group Ltd. The Court is being asked to decide whether Article 11 of the European Convention on Human Rights requires states to protect striking workers against being subjected to detriment by their employers. If so, the Court will consider whether any remedy lies under sections 3 or 4 of the Human Rights Act 1998.
