Ruth Kennedy has co-authored an article with Rachel Nolloth and Siobhan Murray from Farrer & Co outlining the implications for sports organisations following the judgments in For Women Scotland Ltd v The Scottish Ministers and Haynes v English Blackball Pool Federation. Earlier this year the Supreme Court determined that the definitions of ‘woman’, ‘man’ and ‘sex’ for the purposes of the Equality Act 2010 (EA 2010) refer to biological sex. The article looks at the first decision based on the application of the sports exemption under section 195 of the EA 2010 following FWS (in Haynes v Blackball Pool Federation).
