Zac Sammour has been in the Employment Appeals Tribunal for the last 2 days on the appeal in Miller v University of Bristol. This is an important case concerning the scope of the protection afforded for freedom of speech and belief within the workplace.
The Bristol Employment Tribunal concluded that the University’s decision to dismiss Miller was direct discrimination because of his anti-Zionist beliefs. The Tribunal also held the dismissal to be unfair and wrongful.
The decision of the of Bristol Employment Tribunal is now being appealed by the University of Bristol. Dr Miller has also cross-appealed.
The EAT is considering (amongst other things) (i) whether the Claimant’s anti-Zionist beliefs are protected philosophical beliefs and (ii) whether the ET erred in determining that the University’s dismissal of the Claimant disproportionately interfered with his rights to manifest those beliefs.
