Joseph Barrett KC appeared for the Applicant, Mr Aubrey Weis in a judicial review challenge under the Subsidy Control Act 2023 (“the SCA”) relating to £120 of loans awarded by the Greater Manchester Combined Authority (“GMCA”) to certain special purpose vehicles within the Renaker property development ‘group’.

The case is the first occasion on which the Competition Appeal Tribunal has addressed the operation of the ‘commercial market operator’ principle under s. 3(2) of the SCA.

The CAT’s judgment is expected to have significant implications for the conduct of future subsidy control legal challenges, and the operation of the legislative scheme established by the SCA
