High Court judgment gives guidance on school compliance with PSED

There is now a judgment of the High Court providing guidance on the discharge of the public sector equality duty by schools when making exclusion decisions.

In R (TZA) v A Secondary School [2023] EWHC 1722 (Admin), the issues considered include: the respective roles of a head teacher and the governors in discharging the duty; the extent of the duty when the decision at issue is an individual exclusion; and the extent of the duty to explain discharge of the duty at the different stages of the process of challenging an exclusion decision.

Tom Cross acted successfully for the school. You can read the judgment here.
