High Court gives guidance on role of the OIA for Higher Education


In Zahid v University of Manchester, Mr Justice Hickinbottom has provided crucial guidance for Universities and students about the relationship between court claims for judicial review and complaints to the Office of the Independent Adjudicator for Higher Education (“OIA”). Must a student who has a dispute with their Higher Education Institute (“HEI”) always complain to the OIA before issuing a claim in the court, and what steps do the parties need to take properly to protect their positions? Paragraphs 69-94 of the Court’s judgment, in particular, provide important guidance.
