First fine for public authority for contempt of court in FOIA case

On 8 May 2026 the Upper Tribunal handed down judgment in Cleasby v University of Exeter & Information Commissioner [2026] UKUT 187 (AAC), fining the University of Exeter £15,000 for contempt of court for failing to disclose information within a time limit set by the First-tier Tribunal.

This is the first time the Upper Tribunal has issued a fine to a public authority for contempt of court in a Freedom of Information case. Ceclia Ivimy KC acted for the University of Exeter. Oliver Jackson acted for the Information Commissioner. The judgment is available here.
