Judy Stone KC represents the former chief executive of Britain’s largest estate agency, in his successful claims of constructive unfair dismissal and for age discrimination against Connells and its parent company Skipton Mr Livesey had spent 33 years at Connells, almost 20 years as its chief executive .
In its recent decision, the tribunal found that, during ongoing discussions about his retirement plans , the company removed Mr Livesey from the business without warning, before attempting to “re-write history” by retrospectively claiming in a “disingenuous document” that he had resigned. He was then given 46p for shares that had cost him £420,000, when his younger colleagues had received far more for fewer shares. The tribunal held that there was no satisfactory explanation for these surprising and unreasonable actions, which amount to discrimination on the grounds of age.
A remedies hearing is due to take place later this year.
