Aileen’s Practice note on ‘transgender pupils in schools’ summarises out the law relating to the treatment of transgender pupils in schools in England. The note discusses relevant guidance including the draft non-statutory guidance on gender questioning children recently issued by the Department for Education. It considers schools’ legal responsibilities to trans pupils, including general obligations to support pupils’ health and wellbeing. It also discusses how schools should approach transgender pupils’ proposed social transition, including in contexts in which pupils are typically separated by sex, such as competitive sports and access to sanitary facilities and accommodation.
