Following the judgment of Coulson J upholding the automatic suspension on contract-making in Bristol Missing Link Ltd v Bristol City Council [2015] EWHC 876 (TCC) the Defendant, Bristol City Council, agreed that tenders should be subject to an independent process of reevaluation and moderation. That process has now been completed and has confirmed that Bristol Missing Link (“BML”) submitted the most economically advantageous tender in the procurement.

Bristol City Council has now entered into a new contract with BML.

The litigation, and its outcome, underlines the importance of maintaining the automatic suspension in EU procurement challenges.
