R (Barclay) v Secretary of State for Justice

This Supreme Court judgment will now be the leading domestic authority on Article 3 of the First Protocol to the ECHR (the right to free elections). The case involved a challenge by the Barclay brothers to the new constitution of Sark, one of the Channel Islands. In dismissing the Barclay brothers’ appeal, Lord Collins took the opportunity to provide a detailed analysis of the relevant jurisprudence and applicable principles. Ben Hooper appeared as junior counsel for the Secretary of State.
