R ota E v JFS

The Supreme Court in R ota E v JFS has decided, by a majority of 5-4, that JFS’s oversubscription policies, which gave admission priority to those regarded as Jews by the religious authorities, were in breach of the Race Relations Act. This is because Jews are defined as such by reference to their descent. Each of the 9 justices gave a substantial judgment, and there is much discussion and disputation about prior House of Lords’ decisions on direct discrimination such as James, Khan and Nagarajan. This is an important decision for all fields covered by discrimination law. 11KBW’s Peter Oldham acted for the school throughout the litigation. Clive Lewis QC acted for the Schools Adjudicator.
